No:20\/B \u00dcsk\u00fcdar \u2013 \u0130stanbul<br \/>\n<strong>Phone:<\/strong> +90 216 461 11 55<br \/>\n<strong>Email:<\/strong> <a href=\"mailto:info@momy.com.tr\">info@momy.com.tr<\/a><\/p>\n<h3>2) General Provisions<\/h3>\n<ol>\n<li>By placing an order on the website, <a href=\"https:\/\/momy.com.tr\/en\/pre-information-form\/\">Pre-Information Form<\/a> and <a href=\"https:\/\/momy.com.tr\/en\/distance-sales-agreement\/\">Distance Sales Agreement<\/a> it is deemed accepted.<\/li>\n<li>Purchases are subject to Law No. 6502 and the Regulation on Distance Contracts.<\/li>\n<li>Products are dispatched for delivery within the period stated in the order and no later than 30 days.<\/li>\n<li>The product is delivered in conformity with the specifications in the order and, where applicable, with a user manual\/warranty card.<\/li>\n<\/ol>\n<h3>3) Payment Confirmation \/ Delivery Impediments<\/h3>\n<ul>\n<li><strong>Non-payment\/Bank cancellation:<\/strong> If payment is not completed or is cancelled in bank records, no delivery obligation arises.<\/li>\n<li><strong>Unauthorized card use:<\/strong> If, after delivery, the bank withholds payment due to unauthorized transactions, the product may have to be returned to the seller within 3 days.<\/li>\n<li><strong>Force majeure:<\/strong> In unforeseen circumstances, the buyer is informed and offered options: cancellation, replacement with an equivalent, or postponement until the impediment ceases. In case of cancellation, a refund is made within 14 days at the latest (bank posting time may vary).<\/li>\n<\/ul>\n<h3>4) Inspection upon Delivery<\/h3>\n<p>Check the package before accepting delivery; return damaged\/deficient items to the courier with a report. If the right of withdrawal is to be used after delivery, the product must be kept in saleable condition.<\/p>\n<h3>5) Retail (B2C) \u2013 Right of Withdrawal<\/h3>\n<ul>\n<li><strong>Period:<\/strong> From the delivery to you or to the person you designate <strong>14 days<\/strong>.<\/li>\n<li><strong>Notice:<\/strong> Submit your withdrawal request in writing via e-mail or the return form. It becomes effective upon receipt by the seller.<\/li>\n<li><strong>Return shipment:<\/strong> After your withdrawal notice, send the product <strong>within 10 days<\/strong> together with its original box\/accessories\/tags. Attach the original invoice or e-invoice details. (For corporate invoices, a return invoice may be required.)<\/li>\n<li><strong>Refund:<\/strong> Within, at most, from receipt of the withdrawal notice <strong>14 days<\/strong> the amount is refunded via your original payment method. The shipping fee charged for the initial delivery is also refunded.<\/li>\n<li><strong>Return shipping fee:<\/strong> Unless otherwise stated in the preliminary information, the return shipping cost is borne by the consumer.<\/li>\n<li><strong>Effect of use:<\/strong> If the product shows signs of use beyond reasonable in-store testing, a deduction may be applied for diminished value.<\/li>\n<\/ul>\n<h4>5.1) Cases Where the Right of Withdrawal Cannot Be Used<\/h4>\n<ul>\n<li>Products prepared\/customized according to the consumer\u2019s personal requests (e.g., custom samples, personal prints, etc.),<\/li>\n<li>Items not suitable for return for health\/hygiene reasons; underwear\/socks etc. whose protective packaging has been opened,<\/li>\n<li>Products that are perishable or near their expiry date,<\/li>\n<li>Services performed instantly in electronic form or digital content delivered immediately,<\/li>\n<li>Products that, after delivery, are mixed with other items in such a way that they cannot be separated.<\/li>\n<\/ul>\n<h4>5.2) Return Package Contents<\/h4>\n<p>The product box, any spare accessories, gift\/promotion items, and invoice details must be packaged so as not to be damaged during shipment.<\/p>\n<h3>6) Wholesale (B2B) \u2013 Returns\/Cancellation<\/h3>\n<ul>\n<li><strong>Right of Withdrawal:<\/strong> Purchases by merchants\/tradesmen are B2B; the consumer-specific right of withdrawal under the legislation does not apply.<\/li>\n<li><strong>Return Condition:<\/strong> Return\/defective-goods procedures <a href=\"https:\/\/momy.com.tr\/en\/bayi-sozlesmesi\/\">Dealer\/Framework Agreement<\/a> are as set out in the B2B portal announcements. RMA\/service procedures and timelines operate pursuant to these provisions.<\/li>\n<li><strong>Delivery and Transfer of Risk:<\/strong> Unless otherwise agreed, damage\/risk passes to the buyer upon delivery to the carrier.<\/li>\n<li><strong>Price &amp; VAT:<\/strong> B2B prices may be exclusive of VAT; taxes and legal obligations are applied separately.<\/li>\n<li><strong>Default:<\/strong> In case of overdue payment, the default interest and costs in the contract apply.<\/li>\n<\/ul>\n<h3>7) Payment and Delivery<\/h3>\n<ul>\n<li><strong>Bank:<\/strong> Wire\/EFT transactions may be made to the IBAN account at AkBank T.A.O.
