This website and related services (“Site”), are operated by Uğurlu Ayakkabı San. ve Tic. Ltd. Şti. (Momy Kids Shoes). By using the Site, you are deemed to accept these Terms of Use. If you do not accept the terms, please do not use the Site.

These terms may be updated from time to time. The current version takes effect as soon as it is published on this page. We kindly ask you to review this page each time you visit the site.

1) Definitions

Member/Account Holder: A natural person or representative who creates an account on the Site.
Customer: A natural person making retail (B2C) purchases.
Dealer/Business Partner: A trader/merchant making wholesale (B2B) purchases, or a representative acting on behalf of a legal entity.
Services: E-commerce functions, content, forms, notifications, and all similar online services.

2) Capacity and Account

As a rule, the Site is for users aged 18 and over. Purchases made on the Site by persons under 18 are under the responsibility of their parent/guardian. You are obliged to provide accurate and up-to-date information when creating an account, to protect your password, and to be responsible for actions taken through your account. Please notify us immediately of any suspected unauthorized use.

3) Privacy and Cookies

Your personal data, KVKK Information Notice, Privacy Policy and Cookie Policyare processed in accordance therewith.

4) Intellectual Property

The designs, texts, images, trademarks and logos, as well as software on the Site are protected under applicable laws. They may not be copied, reproduced, distributed, or reverse-engineered without prior written permission. MOMY KIDS SHOES is a registered trademark of Uğurlu Ayakkabı.

5) Prohibited Uses

Unauthorized access to the Site or systems; data scraping/bot/automated crawling; security breaches.
Deceptive orders, use of fake/unauthorized payment instruments, attempted fraud.
Acts that are unlawful, infringe rights, or constitute misuse.

6) Content, Pricing, and Stock

Product images are illustrative; colors/tones on screen may vary. Prices, stock, and technical specifications may be updated without prior notice. In case of an obvious typographical error, the order may be canceled and the amount refunded.

7) Provisions Regarding Retail (B2C) Purchases

Contract: For each retail order Pre-Information Form and Distance Sales Agreement provisions apply.
Payment & Delivery: Shipment starts after payment approval and stock verification. Delivery and shipping terms are subject to the options stated at checkout.

Prices: Unless otherwise stated on the page, prices include VAT.

8) Provisions Regarding Wholesale (B2B) Transactions

Access/Approval: Access to the B2B portal is granted only after dealer/partner approval. Application and login: Reseller Login.
Contractual Framework: All B2B transactions are governed by the Dealer/Framework Agreement and its annexes (minimum order amount, delivery, transfer of risk, return terms, payment term, etc.).
Pricing: B2B prices may be shown excluding VAT; unless otherwise stated, VAT and legal obligations are added separately.
Orders and Reservations: B2B orders depend on stock and production schedule; Momy Kids Shoes may make partial shipments or offer alternative lead times when necessary.
Returns/Exchanges: In B2B, returns are accepted only in cases of defective/nonconforming goods as defined in the contract and in accordance with the procedure.

9) Electronic Communications

You may update or decline your preferences regarding commercial electronic messages at any time. Communications to traders/artisans fall under applicable regulations; the right to opt out is reserved.

10) Third-Party Links and Integrations

The Site may connect to payment, shipping, analytics, map, and social media plugins. The content and policies of these services belong to the respective third parties.

11) Limitation of Liability

The Site is provided “as is”. To the extent permitted by law, no liability is accepted for indirect/consequential damages, data loss, loss of profit, business interruption, etc. This provision does not apply to cases that cannot be limited by law (e.g., gross negligence).

The Site or these Terms may be updated without prior notice. In case of breach of the Terms, your access may be suspended or terminated.

13) Governing Law and Jurisdiction

The law of the Republic of Türkiye applies. For disputes, the Istanbul Anatolian Courts and Enforcement Offices have jurisdiction.
